General Terms and Conditions (GTC) of SWIVON
1. Scope of Application
These General Terms and Conditions (GTC) apply to all services provided by SWIVON, unless amended or supplemented by written agreement. By booking a service, the customer accepts these terms.
Deviating or additional customer terms shall not apply unless expressly approved in writing by SWIVON.
2. Scope of Services
SWIVON provides transportation services (transfers) according to the current service descriptions on our website or individual offers.
The price includes the trip from the agreed pickup location to the destination and standard luggage assistance.
Special requests (e.g., additional stops, waiting times, special transport) must be agreed in advance and may result in additional costs.
3. Offers
Our offers are time-limited, either in accordance with legal requirements or as specified in the offers themselves.
All offers are confidential and may only be shared with individuals evaluating or processing the offer.
4. Prices and Orders
All prices listed on our website or in offers are gross prices (including VAT).
Bookings are binding for the customer. A legally valid contract is concluded upon booking.
5. Payments
SWIVON accepts the following payment methods: credit cards, cash in the vehicle, invoice, and bank/post transfer.
Payment is due no later than 10 days after completion of the service, unless otherwise agreed.
Withholding payments or offsetting with unrecognized counterclaims is not permitted.
6. Cancellations
In case of cancellation, the following fees apply:
Up to 24 hours before service: no charge
24 to 4 hours before service: 50% of the agreed price
Less than 4 hours before service or “no-show”: 100% of the agreed price
7. Waiting Times and Flight Delays
A waiting time of up to 15 minutes at the pickup point is included in the price.
For airport pickups, the flight arrival time is monitored. Delays caused by flights are not additionally charged.
Additional waiting time not related to flight delays may be charged based on effort.
8. Customer Responsibilities
The customer is responsible for providing accurate and complete information (pickup point, destination, time, flight number, number of passengers, luggage details).
Incorrect or incomplete information may lead to delays for which SWIVON assumes no liability.
9. Behavior in the Vehicle
Smoking is prohibited in all vehicles.
Eating and drinking alcoholic beverages is not allowed.
Customers are liable for intentional soiling or damage, and related costs will be charged.
10. Insurance
All SWIVON vehicles are insured in accordance with Swiss legal requirements.
Liability for luggage is limited to standard insurance coverage amounts.
11. Liability
SWIVON is not liable for delays caused by force majeure (natural events, traffic jams, accidents, breakdowns, government orders, or other circumstances beyond our control).
Liability for indirect damages (e.g., lost profits, missed flights, consequential costs) is excluded.
Maximum liability is limited to the price of the booked service.
This does not apply to damage to life, body, or health resulting from intentional or grossly negligent acts by SWIVON.
12. Right of Withdrawal
There is no legal right of withdrawal under EU consumer protection regulations in Switzerland.
The cancellation policy (see section 6) applies as the binding basis.
13. Intellectual Property
All texts, logos, trademarks, images, and other content on the SWIVON website are the intellectual property of SWIVON or its licensors.
Use beyond what is necessary for booking and performing the service is prohibited without SWIVON’s express written consent.
14. Data Protection
Personal data is processed solely in accordance with Swiss legal requirements and our privacy policy, which is available on our website at any time.
15. Changes to the GTC
SWIVON reserves the right to change these GTC at any time.
The version published on our website at the time of booking is binding.
If any provision of these GTC is invalid or unenforceable, the validity of the remaining provisions remains unaffected.
16. Assignment
SWIVON is entitled to transfer rights and obligations under these GTC to third parties, provided this does not conflict with legitimate customer interests.
The customer may not assign rights or obligations under this contract without SWIVON’s written consent.
17. Jurisdiction
Swiss law exclusively applies.
The place of jurisdiction for all disputes is Bülach (Switzerland).
Mandatory consumer protection laws of the country where the customer resides remain unaffected.
SWIVON always strives to resolve any differences with customers amicably and by mutual agreement.
